Terms & Conditions for AMC

  1. Service Overview
    SmileyHub.in offers WordPress website maintenance services to ensure the smooth operation, security, and performance of your website. These services include, but are not limited to, regular updates, backups, security checks, and performance optimizations.

  2. Scope of Services
    The maintenance package may include the following services based on the selected plan:

  • WordPress Core Updates
  • Theme and Plugin Updates
  • Regular Backups (depends on the package purchased)
  • Security Monitoring and Malware Removal
  • Performance Optimization
  • Uptime Monitoring
  • Database Optimization
  • Content Updates (limited to a specified number of hours per month)
  1. Exclusions
    The following services are not included in the maintenance packages:
  • Major website redesign or development
  • Custom plugin or theme development
  • Content creation beyond the included hours
  • Emergency support or major issue fixes not covered by the maintenance package
  1. Client Responsibilities
    The client is responsible for providing access to the WordPress admin panel and hosting account.
    The client must ensure that all software licenses (e.g., premium themes or plugins) are valid and up-to-date if it’s not added by SmileyHub.in.
    The client agrees to provide all necessary content, images, and information required for updates.
    If the client’s hosting is incapable of specific tasks, it should be resolved by the client.

  2. Payment Terms
    All payments are required in advance for the selected maintenance period (monthly, quarterly, or annually).
    The service will commence only after payment has been received.
    Any additional services outside the scope of the maintenance package will be billed separately.

  3. Support and Communication
    Support is provided via email or through a dedicated support ticketing system.
    Response times are typically within 24-48 hours during business days.
    Emergency support may be available at an additional cost.

  4. Service Availability and Uptime
    While we strive to maintain a high level of service availability, SmileyHub.in cannot guarantee 100% uptime.
    Scheduled maintenance or unforeseen technical issues may result in temporary service interruptions.

  5. Backup and Data Recovery
    Regular backups will be performed as per the maintenance package.
    In case of data loss, the latest backup will be used for restoration.
    SmileyHub.in is not responsible for any data loss that occurs outside of our maintenance activities.

  6. Security and Liability
    Security monitoring and malware removal services are provided to reduce the risk of attacks.
    However, SmileyHub.in is not liable for any damages, losses, or breaches that occur despite these precautions.
    The client agrees to maintain strong passwords and follow security best practices.

  7. Termination and Refunds
    Either party may terminate the maintenance agreement with 30 days’ written notice.
    Refunds are not provided for any unused portion of the maintenance period after services have commenced.
    SmileyHub.in reserves the right to terminate the agreement immediately in cases of non-payment or breach of terms by the client.

  8. Limitation of Liability
    SmileyHub.in shall not be liable for any indirect, incidental, or consequential damages arising from the maintenance services.
    Our liability for direct damages is limited to the amount paid by the client for the maintenance services during the affected period.

  9. Governing Law
    These terms and conditions are governed by and construed in accordance with the laws of Tamil Nadu, India.
    Any disputes arising from these terms will be resolved in the courts of Tamil Nadu, India.

  10. Amendments
    SmileyHub.in reserves the right to update or modify these terms and conditions at any time without prior notice.
    Continued use of the maintenance services after any changes constitutes acceptance of the new terms.

  11. Acceptance of Terms
    By purchasing a maintenance package, the client agrees to these terms and conditions.
